Dell XPS 13 - Modern Sleep

Closed the lid today and put it in my rucksack. Took it out two hours later and it was roasting, fans roaring and battery nearly dead. This also happens when "sleeping"…

Closed the lid today and put it in my rucksack. Took it out two hours later and it was roasting, fans roaring and battery nearly dead. This also happens when "sleeping" overnight.

Doing a bit of research online it appears this a Dell problem with "Modern Sleep" where the system keeps running while asleep. After spending nearly 2k on this im totally dissatisfied with this. Would this be grounds for a return to exchange? I know some of these shops make it as difficult as possible to return stuff.
