    Section 49 (1) RTA 61-06. Intoxicated driving a vehicle (simplicator)

    Arrested under Sect 49 (8) or required to go to station under Section 14. Specimen of blood taken or urine provided. Specimen sent to Medical Bureau of Road Safety for anaylsis who in turn test for Alcohol and drugs if no Alcohol present.

    Yep same procedure really as Drunk driving.

    Section 49 Rta states intoxicated driving so thats drink, drugs or combination of both. If a sample is taken then it is tested for Alcohol, but you can also request for it to be tested for drugs. If both is found then of course only one prosecution is taken for the combination.

    Also on a side note, if you are arrested for drunk driving and brought to the station and provide a breath specimen for analysis, and return under the limit, members can then require a blood/urine specimen for drug anaylsis!! A lot dont realise this

    The one caveat I hate is the fact that cannabis stays in your system for over 24 hours after smoking it.
    Despite it wearing off after <2 hours, you could still be bagged the next day and be done for drug driving despite not being under the influence at all.
    It's mad, because in places like the US and Canada where police have a much more heavy handed approach to things, Cannabis is now recreationally legal.
    So I wonder how that fares out.
    I think those drager tests are a load of BS for cannabis in particular.

    I suppose people who frequent this habit have little regard for other road users
    I would surmise the will be walking
    eventually
    Ya probably end up with a criminal record
