Cigarette allowance from eu

    Hi

    I know this has been covered elsewhere but does anyone know exactly what is the legal amount of cigarettes allowed for personal use to be brought back on person from the EU.

    When revenue state 800 is generally allowed for personal use, is it considered a reasonable guideline amount or is it the law and any excess over 800 will be confiscated by customs.

    This. However the special restriction for Bulgaria, Croatia, Hungary, Latvia, Lithuania and Romania (300 cigarettes) is the actual law.

    As far as I know those specific country restrictions expired in January of this year, it's 800 guideline amount now from all member states.

    Revenue website mentions no restrictions:

    Derp! You're right. I checked that the SI (553 of 2013) was still in force, which it is, but it has a built-in expiry date of 1st January 2018.

    Outside of those countries is the 800 a guideline figure or the law. Is it black and white or grey area. Does the EU Leave it to each member what to enforce their own restrictions on tobacco/alcohol etc.

    It's grey. The letter of EU law says there is no limit to the number of cigarettes for personal use that a person can transport between areas in the customs union. If the customs officer on the day thinks you might be a smuggler, however, they can take the cigarettes off you. Explaining your take on the law to them will not make them magically say "Oh, sorry, you're right. Have your ciggies back." It's up to their discretion and while there may be an appeal process it's probably going to be awkward and time-consuming. If you feel like having that row with the State at some point, take more than 800 cigarettes in. For a guaranteed quiet life bring 800 or fewer.
