Interim Legal Costs

Without direction from a judge, who is the only one who can award costs in litigation, what right does KBC have to apply interim legal costs to borrowers' mortgage accounts before repossession proceedings are even close to reaching a conclusion?

How is applying such interim legal costs to borrowers' mortgage accounts not in direct contravention of Section 2.1 and 2.2 of the Consumer Protection code which requires you to act in the customer's best interest?
