A lot of people including Munster rugby and the42.ie have referred to Farrell's situation as legal issues in relation to witnessing an offense.

This was the Munster statement in September.

Munster Rugby and Chris Farrell have agreed that, with immediate effect, he will be stepping back from his involvement with the Munster squad whilst legal proceedings in France, concerning his alleged involvement as a witness to an alleged crime in 2017, are on-going,

This was a deliberate attempt to muddy the water in the public eye so that Farrell and Munster would be less affected by negative publicity.

If the case was in Ireland that's all Farrell would be. A witness. However in France there's a duty on people if they know a crime will be committed to act.

Haven’t followed this at all and don’t know details so no assumptions here so this is a genuine question but is what farrell accused of a crime in ireland? Typically there is no obligation to stop a crime - morality aside of course when you are built like him.

i wonder whether he will try and defend trial. France certainly aren’t opposed to conviction in absentia.

It generally wouldn't be a crime here.

There are edge cases on the border where knowing a crime will happen can be prosecuted as conspiracy but that would be rare.

No, it's not a crime in Ireland. That's not to say that failure to act could amount to a tort in certain circumstances but criminal liability does not arise in such instances in common law jurisdictions (at least to the best of my knowledge).

This outcome suits both parties. Farrell gets to play while awaiting the trial and the IRFU no longer have to play a player to not play. I doubt its anything to do with being squeaky clean.

To be fair , if it had nothing to do with being "squeaky clean" then Farrell wouldn't have been sidelined for the whole season - He'd have been playing away like several other players involved in this case.

Agree that this is a good outcome for both parties , but for Munster and the IRFU this is all about the optics of how they handle this.

If Farrell had been selected while this was hanging over him, the Irish rugby media would have used it as a stick to beat Munster with Mercilessly.

I'm glad it's over and they came to a mutual agreement.

This assumes that Farrell actually has a move lined up (TBD) and that he didn't get paid off (we'll never find out).

Based on what we know for sure as of today, this outcome suits Munster and IRFU only.

I would be surprised if a tort arises over a bystanders failure to act. Although it’s been quite a while since my tort exams - no obligation to save a drowning man etc - albeit case law may have evolved since then.

Going to be a sad ending to a decent career, it should serve as a lesson to other players, anything dodgy going on get out of stuck or report it

A salutory lesson for sure. One learning could be if you witness rape or sexual assault using some kind of object, like a crutch, to intervene, or maybe even make a statement to the police. You might even say it's a lesson to non-players and just general humans.

Scarlets defend with a really fas line speed, but very disconnected, especially on the edges. Can see why they;ve been very porous this season.

Scarlets are not good. But they are really competing on the deck, and haven't won a penalty yet, I don't think.
