I sent an email to the ODTR asking whether Eircom can challenge the recent decisions. Here it is.

Thank you for your email regarding local loop pricing.

The prices are set on an interim basis and in approving final prices , the
Director will review them in light of an appropriate and adequately cost
    justified submission by eircom.

The setting of these prices does not relieve eircom of its responsibility to
address the deficiencies in its pricing proposals and to make a
comprehensive re-submission to the ODTR on all matters.

The general legal principle is that all our decisions can be challenged. We
believe the decision is a fair and proportionate intervention, but if Eircom
wishes to challenge it in the courts, this is a decision for them.

they're always going to say that, makes them look like the injured party. I doubt they will.
