Internal Job Advertisement legalities...

    Just out of curiousity....

    Do internal positions have to be advertised within a company to all employee's?

    I wonder if someone could clarify the legalities of this....

    in my blokes place, when they want to hire someone from the outside, but are oblidged to advertise in company, they hang a tiny little notice in the corner of the canteen during the weekend and take it down again before anyone actually sees it - but they did their legal duties and can't be caught up on it.

    afaik, everyone should get a fair shot, but in reality, there are ways round everything....

    Private company? They can do whetever they like unless there is a standing agreement with the union.

    It may not matter, this could be a law that any company is bound to. I seem to remember it being in place in my last company which was a small privately owned company.

    Anyway, as Beruthiel said, there are lots of ways around these type of things - I doubt they even have to interview an internal candidate that applied, they just have to let him/her apply in the first place.

    AFAIK, there is no blanket legal stance.
    It can vary depending on trade union stance (mentioned already) or just comany policy.
    Some companies I've worked for mention this as proud company policy and use it to motivate staff (seeing other rise thro' the ranks).
    Its also an advantage for the employers as they'll know the backgorund and skill level of the applicatents.
    Larger companies will tend to have a intraweb jobs notice board... you'd have to question why they'd leave a specific job out if this is the case.
    Have you asked HR what their policy is?
