'Protective'/Lay off notice query...

    I've been going through the oasis.gov website and am none the wiser as to a couple of points with regard to redunancy and I wonder if anyone can clarify if they have good knowledge of this type of thing.

    Basically, work is short within my husbands company and there's possibilty of him being laid off...he has worked for the company for 3 years.

    * Is there such a thing as 'protective notice' (this is what he was told he was being put on) and what does this mean as I cant find reference to this on the Oasis.gov site.

    * From what I can see there is a term 'lay off notice' which means that the worker can be laid off for 4 weeks and if after that 4 week term there is no guarantee of employment a claim for redundancy can be made. What notice is required for 'Lay off notice' eg if your told this is a possibility could you be let go the next day or does the 2 week minimum notice apply.

    * Does notice of either scenario (eg outright redundancy or lay off notice) need to be given verbally or must it be in writing.

    * If during a 4 week lay off period, you find alternative work, does this exempt you from any possible redundancy pay?

    Would really appreciate it if anyone knows anything about the above as he has meeting with boss tomorrow and cannot seem to find the info needed so he knows where he stands.

    AFAIK (and I could be wrong) you're entitled to a certain amount of pay per every year employed. I think its only two weeks. Sometimes companies add more to it, to sweeten the deal. Other than that the usual rules of notice apply. If they sudenly let you go then they pay you as normal for the period of your notice. Alternatively they can ask you to work part or all of your notice period.

    I've never heard of 'lay off" or Protective" notice, myself. Generally if you ring or email the contact numbers on the Oasis site, you'll get all the most accurate info. Don't really on the companies HR or managment. They often get it wrong.

    As far as I remember protective notice is required if a company is going to let go a large number of people. It is there to allow the union or employee representative to try and negociate a reduction in cut back.

    I think it may also be used to assist the company in negociate a possible salary reduction. I dont think that it offers anything to an individual employee.

    In anycase if he leaves before the redundency date then there is a risk that you may lose any entitlement to redundancy payments.
