    well i know that where i work part time if we mis price something the customer gets it at the advertised price. im not sure if this is the law or if its just us being nice!

    Happens to Dell all the time.

    They never honor the mis quoted price. Invitation to treat and all that....

    I'm sure it'll be spotted, seeing as they're out of stock it'll probably be spotted before they come back in. Especially if they're out of stock after a rush of bordsies buying them :)

    AFAIK the law is more that it has to be advertised at the price it's being sold for as opposed to it has to be sold for the price it's advertised for. Breaking it, especially in an obvious accident like this is no big deal. A lot of shops (mainly bricks and mortar stores) will honour the price if it's not a huge mistake out of niceness to the customer.

    They've no legal obligation as its simply an invitation to treat and somehow i don't think they'll sell their entire stock of them and a host more orders at a €1000 reduction which represents a masssive loss.

    With the Dell threads that have been here before, they have covered themselves by not confirming any orders at the wrong price.

    But if Komplett have sent email confirmations and charged credit cards, would that not suggest that the sale has been completed?

    EDIT - muppetkiller, can you see the charge on your online Visa account?

    My order was confirmed straight away and the invoice was sent via mail. I have no idea if the card has been charged yet.

    Didn't get the email, but the order status is confirmed. Don't know about credit card though. Just seems too good to be true.

    Same here, the order says it's confirmed on my komplett page, so fingers crossed. I also got the email invoice.

    The only way I could ever afford a telly like this is with this kind of windfall, so here's hoping that they cover it. They seem to have painted themselves into a corner by confirming it.

    Looks like they've started the cleanup. :o

    The order has disappeared from my Komplett page - they'll probably spend a few hours working on the email and then we'll hear from them.

    Komplett put a charge on your credit card when you place the order, but do not actually withdraw the funds from your credit card until they actually ship the order.
    A charge does not represent funds withdrawn from your card- but if you check you will see that your remaining available funds have been reduced by the amount of the charge.

    Any charges that are not confirmed within 10 working days automatically lapse, without any detrimental charges to the credit card holder.

    Dear Sir,

    Apologies, but we have cancelled you order due to a genuine pricing error on our part.
    The price was listed at a rather too generous €111 - this was obviously a mistake and we cannot sell at this price.

    "legalities" is a real word, in case that's why you put it in quotes!

    The fact that the order was confirmed by Komplett may be considered a contract as by this stage: They have given a price, I have found that acceptable (very) and offered to pay it. By letting me checkout and arrange payment and shipping details they have effectively accepted that offer.

    Yeah, read that as well - next paragraph is:
    And it is also possible for the courts to declare a contract void if the seller has made a genuine mistake.

    And as you can see from the email from Komplett, they specifically mentioned a genuine mistake:
    Apologies, but we have cancelled you order due to a genuine pricing error on our part.

    Still, as I said earlier a contract would appear to have been formed as payment & shipping was arranged.

    This is more of a consumer issues thread at this stage, should it be moved?

    Well, it was too good to be true. It was worth a shot, sure they might have...

    When I first saw it for sale, I though yeah it might be a mistake, but there's that chance in a thousand it's a sale - get the order in quick!

    That was before I realised what it was worth - a grand don't come for free. ;)

    Anyhow, for future reference, their confirmation emails don't constitute a contract. linky

    Komplett conditions:

    "Our order confirmation does not constitute a contract. It is merely a confirmation that we have received your "request to purchase". The contract is the Invoice which is issued when we finalize the sale and physically remove the funds from the customer's credit card. "
