    EC approves Arcep VoIP regulations

    The European Commission has approved the regulatory framework for VoIP established by French telecoms regulator Arcep, citing its ability to stimulate competition in the fixed phone area, AFP reports. The EC nevertheless invited Arcepo to watch this part of the retail market carefully to avoid any anti-competitive behaviour, and if necessary, to intervene and correct it.

    The Commission has released its findings on French proposals to include Voice over Broadband within the relevant market for voice, but not to impose economic regulation. This has been presented by the Commission as a precedent on their approach to VoB/VoIP regulation and also establishes the - perhaps somewhat worrying practice - of regulators finding SMP in a market but imposing differential remedies within that same market.     The Commission's justification for approving ARCEP's proposal is that the offer is replicable by other operators through use of bitstream and unbundled access to the local loop. However they stress that the regulator will need to continue monitoring the retail market to guard against price squeeze or predatory pricing.

    Other markets which are likely to raise interesting issues around VoIP although have not yet been notified to the Commission are Germany (includes VoIP in relevant voice market (after extensive analysis), but no remedies yet identified) and Netherlands (includes VoIP in relevant voice market and proposes that KPN notify retail tariffs in advance for approval).

    Meanwhile today at a Vodafone Investor Conf Call/Meeting the Vodafone CTO Thomas Geitner was asked about VoIP and blocking VoIP he said blocking VoIP was a bad idea and they wouldn't do it (Voda 3G Germany begs to differ) and that VoIP is going to happen and that they should get on with living with it.
