Holiday Pay

    i know this has prob come up a bit since were in the holiday season , but was wondering if any knows am i entitlied to holiday pay from last year , started job ( Part Time) in october and havent taken holidays yet , but was wondering can i get screwed by employer for these 3 months work with no holiday pay ? im part time so i know holiday pay is calculated at 8% of earnings and i dont want to miss out on theses holurs as i work a bit extra over christmas last.

    Yes of course you are entitled to it - 8% of your earnings worked in holiday pay if you haven't already received them

    In addition, annual leave should be taken within the appropriate leave year, or with your consent, within 6 months of the relevant leave year.
    Depending on if the annual leave year ended in December or March, that just references taking the annual leave though, as far as I know you are still entitled to it.

    I'm not sure. They can't pay him in lieu of his holidays, and as the site says, the leave should be taken within the appropriate year. In our place, for example, the year ends on 30th April. You then have 6 months to use up any spare leave. But if you haven't taken it by the end of October, it's gone. Afaik though, it's the employer's responsibility to set the employee's holidays. So if your holidays aren't used up and they expire, it's essentially your employer's fault for not making you take them.

    I have no idea how you'd go about being compensated for them.

    Yep - same.
    If you don't use your holidays earned from Jan 2004 - Jan 2005 by 31st March 2005 you just get x days extra pay in your April paycheque and lose the holidays.

    That doesn't sound right. I'm almost certain that the only situation when you can be paid in lieu of statutory holidays is when you are leaving a job. In a normal direct employment situation it's illegal.

    Holidays should be taken within the year or within six months of the year (with your concent). Anything further is entirely at the discression of the employer.
