Can they start paying me less?

    I started a new job in Feb.I signed a contract saying that my rate of pay 8.21/hr. But I have been paid 9.79/hr ever since. However, I had to go to my manager about something to do with my wages, she saw that i'm being paid too much and has informed head office. My rate will now be changed back to 8.21/hr. Can they do this?

    yes so long as its above the minimum wage they can as you signed up for 8.21 an hour. Its a bollix I know but they cant take the money you earned already from you.

    actually, they can.

    if you are contracted to work at a certain rate, and you have been paid something else and its a mistake, then they are entitled to have their money back, as the onus is on you to report it.

    however, for the few sheckles that are in it, i think it would be unlikely.

    oh, and yes, they are entitled to put you back on the pre agreed wage.

    I got stung for €500 a bit like this a couple of weeks ago. They'd been forgetting to deduct my pension for ten months, then suddenly realised it and took it all back in one go. Which kind of sucked. You'll be lucky if they don't take the overpaid wages out of your next salary, I'd say.

    The biggest annoyance in situations like this is that if they deduct the overpaid money from your pay they quite often do it in one go. It's grand if you have a few quid in the bank but if you loose 10 x €50 in one pay cheque your bills, loan repayments and everything else can make things very tight for a while.

    I don't dispute the legal right of the employer to reclaim the money, I just think that doing so in one go where at least part of the blame is the employers is very harsh.

    but of course, if you 'fes up in the first place, you dont lose anything.

    it is a two way street, but i do think that in the case where an employee has to return money, it should be done over a period of time and not in one lump sum.

    of course, the really best way is to do it in the way that causes the least amount of hassle and worry to the employee.
