    They haven't even decided to prosecute yet, let alone decided to close it down. AllOfMP3 seem pretty confident in their assesment of the law, so they could win. Then it'll be up to the lobbyists to get the law changed and they don't really have the same power there that they would here or in the states.

    They have excellent quality downloads at great prices. I've often been tempted to try this myself, especially for rarer stuff.

    I'm glad I've almost cleared the place out if this is the case.
    They're still constantly updating so at least they haven't given up already.

    From reading that it sounds like they're screwed.
    "The Russian site claimed it had licenses to do so from a local clearing house", and that's means alot does it?
    The labels themselves say no so I'd say it's game over.

    That looks like bad news for downloaders, but I'm sure the Russian police force won't like to have been told what to do by america record companies. And if Allofmp3 have a case this could be in the courts for years.

    that sucks i got alot of albums from there over the christmas holidays and yes you can get mp3s free but really soulseek/limewire/kazaa are all truely ****e now for getting complete albums quickly and irc/torrents can be very irritating to find specific albums so allofmp3 was great if you were looking for a specific old album as they have such a big database and the albums were under a dollar anyway so it was worth it to be honest

    mp3search is a very good website. You cannot get the different encoding that allof mp3 offered but it has some stuff that is not on allofmp3. I use both to make sure I have as big a catalogue to choose from as possible.

    their naming conventions for files give me a bit of a headache getting them onto my player but they generally get great stuff ahead of release and quality is tops!

    its all illegal, u are better going to p2p services getting it if u have the time/ patience. dont be deluded to think the copyrightholders will receive a cent for anything u buy there.

    Allofmp3 was a great find about a year ago, I've spent the best part of $100 all told, well worth it in my opinion. I've used P2P software from Napster 1.0 to AudioGalaxy, Morpheus, Kazaa, Limewire, but nothing compares to the assurance of clicking buy these songs, and letting the Allofmp3 Explorer download, rename (karlhoff take note) and organise into folders. It's almost as seamless as the iTMS, but heaps cheaper.
    I'm emptying my account too, who'd have thought I wanted some of the stuffi in my queue now?

    I agree, minimum top-ups are an ominous sign, but I'm topping up by $10 by paypal (they don't have my CC, harder to track in event of them getting busted).

    'However, the holder of right for these recordings did not authorize to distribute them for commercial purposes. At the same time, the Prosecutor found that the Russian Law on copyright does not qualify Internet in legal terms, whereas the authors’ property rights are extended to distribution of copies of their works by any means.

    Along with that, the Prosecutor says that from judicial point of view, distribution of any works via Internet is impossible because it would be a digital transfer, whereas the current Russian legislation necessitates corporeal transfer of works only. Besides that, the Prosecutor concluded that, distribution of works does not result in making a new copy of the work, but only creates conditions for being utilized by end consumer. On these grounds, the Prosecutor’s Office in Moscow’s South-Western district rejected initiation of a criminal case against the Internet resource officials due to absence of corpus delicti. '

    On February 2004 the Computer Crimes division of Moscow City Police recommended that prosecutors initiate a criminal lawsuit against AllofMP3.com, a Russian music site selling MP3 downloads by the megabytes. The investigation was initially launched at the request of IFPI Moscow. The International Federation of the Phonographic Industry previously sued a similar Spanish project, with PureTunes.com settling with the industry for $10 million.

    The case of AllofMP3.com was further complicated by compulsory licensing, adopted by Russian legislature. Compulsory licensing stipulates that licenses should be issued in non-discriminatory manner to anyone who wants to get one on reasonable terms. Russian Multimedia and Network Society was in charge of establishing the reasonable terms, and according to Russian legislation, anyone could distribute music, provided they track downloads and pay back some nominal fee. This is very different from the legislature in the United States, where a music distributor would have to gain a license before selling any music online, and furthermore, could be denied such license for whatever reasons.

    On March 4th prosecutor’s office of Moscow’s Southwestern region refused to charge AllofMP3.com in a criminal lawsuit. What’s interesting is that AllofMP3.com did not win the case due to the compulsory licensing legislated in Russia. The prosecutor’s office affirmed that the Russian music site was distributing copyrighted music from its site, and in many cases did not have a proper license to distribute them. Russian criminal law severely punishes attempts to distribute copyrighted music without proper licensing procured first. However, Russian law is quite specific about distribution of material goods, as the law usually applies to CD and DVD pirating.

    Moscow prosecutor’s office noted that Russian music site does not distribute material goods, and since is not subject to prosecution under the criminal law. AllofMP3.com distributed digital goods via Internet, of which Russian criminal law says nothing. Moreover, prosecutors arrived at the conclusion that since no physical copies of the goods are delivered to the customer, AllofMP3.com can be treated as a service where site visitors can listen to the music. (The fact that it’s more than possible to burn an MP3 to an audio CD apparently escaped law enforcement).

    AllofMP3.com cannot be charged for piracy, prosecutors ruled, under the current criminal law. Which does not prevent musicians and labels from launching civil lawsuits for cases where AllofMP3.com sold copyrighted music and did not pay back the copyright holders. This is the most likely development for label lawsuits in the future, but they will be quite difficult to win if AllofMP3.com can prove it made all the necessary payments to ROMS. Another way, of couse, would be to change the current criminal law to introduce DMCA-like clauses that specifically relate digital distribution and distribution of physical goods. It’s no coincidence that Russian office of IFPI is located in Moscow’s Tverskaya Street, which is also the address for the parliament of the country.

    Russian prosecutors have decided they are unable to take legal action against controversial online music provider Allofmp3.com - despite the music service's lack of sufficient licences to offer the content it does.

    Last week, the Moscow Southwest regional prosecutor's office said no criminal indictment could be brought against the music seller because it has not violated Russia's copyright law, a local blogger has reported (http://moskalyuk.com/blog/allofmp3com-escapes-criminal-lawsuit-for-now/475).

    Yes, AllofMP3.com offers copyright music. No, it does not always have the prior permission of the copyright holder to do so. But Russian law was written to prevent CD and DVD piracy - copyright infringement through a physical medium. Its online manifestation was not something taken into account by legislators.

    AllofMP3.com has won the support of many music buyers by offering songs very, very cheaply. It charges not on a per-track basis, as other services do, but on a per-megabyte scheme. Tracks are available in a broad array of formats, from AIFF to MP3, AAC, Ogg, WMA etc, encoded on the fly at any bitrate the user chooses. The higher the level of compression, the lower the audio quality, but ipso facto, the more you can download for the same amount of money.

    And silly amounts of money at that: $5 for 500MB of music.

    AllofMP3.com maintains what it's doing is legal, under the terms of a licence granted to it by the Russian copyright licensing authorities. Essentially, it can transmit CD content without first gaining the authorisation of the copyright owner, provided it makes a nominal payment for the privilege, which it claims it does. It says its distribution of tracks across the Internet of digital audio files is equivalent to a broadcaster or a cable company transmitting songs as part of their programming.

    Last month, the computer crime division of the Moscow City Police began an investigation into AllofMP3.com's activities after receiving a complaint from the International Federation of the Phonographic Industry (IFPI). The police referred the case to the Prosecutor's Office with the request that the Internet site be brought to book.

    However, because the site is not involved in the physical distribution of unauthorised copies of the songs it offers, it can't be put on trial for breaking Russia's copyright law, the Prosecutor's Office said last week.

    The IFPI has already admitted that AllofMP3.com is operating within a loophole in Russian law, and that a successful prosecution would be unlikely.

    i downloaded some stuff using the pre-paid credit they give you when you sign up, but the files automatically saved themselves as .m3u files(which i cant play on my iriver) any idea how i can convert them to mp3's ?
