    Does anyone here know the legal situation regarding use of a photo without permission. It relates to an issue of the Slate where they used a photo of mine without permission. Not interested in taking action against them but just curious where I would stand if I wanted to.

    Well as the slate is gone you wouldn't get far by chasing them.

    They cannot use an image of yours. However could the slates use come under fair use? Was it in a parody? If that's the case they may be able to use it.

    No it wasn't really a parody. They did an article on a something and took an image off a website to accompany the article. The website has a copyright notice and they could have contacted us to ask to use the flick but didn't

    they had no legal right to use the shot from what you've said here and you'd be entitled to bring them to court to make them pay for use of the photo

    you wouldn't get very much but you'd probably win

    I can't really be bothered taking it to court, I had a photo of mine in the mag which was kind of cool.

    Well then yes it is copyright infringement.
    Your options are:

    Leave it.

    Send a strongly worded letter and ask them not to do it again.

    Track them down and invoice them for use of the image, choose your price.

    Sue them for copyright infringement and any bad reflection their use of it brought on your business and reputation.

    Tackle them in the car park with the spiky bat of justice.

    As i said though, the mag is no longer around and it didn't make money when it was so it would only cost you to pursue it with little chance of returns.
    Anyway it was a great mag that made us all smile. At least you got to contribute :)
