ADVICE PLEASE, need to get purchase of house finalised

    Hi all,

    Please give some advice on my situation.

    Im a widow with 4 children. I have lived in a council house for the past 12 years.

    I began the process to purchase the council house some years ago. I recieved an offer price from the council, which I accepted, and i showed proof of funds to pay. From here, there was huge delays (issues with the ownership not actually being the council, basically paperwork not being complete from when they purchased it). Anyway, I continued to pay weekly rent, for years, to the tune of over €20,000. Eventually, it got sorted.

    I transferred the funds (full purchase price) to the council, and continued to pay rent for 10 weeks. After this, I stopped paying rent as it was unsustainable to pay rent and service the loan I had taken to pay for the house. My solicitor said that the councils solicitor was dragging their heels and again it went on for months. Until, recently, im told that I owe even more rent (over 3000 initially but is climbing each week and now stands at over 5000). This is rent that's being charged to me SINCE I've transferred funds for the property purchase. Im sending emails, ringing them, being pinged around from pillar to post with no one actually dealing with it.

    Do I truly owe them this money? They are outright refusing to finalise the sale/purchase of the house until all arrears have been cleared. I believe that the 10 weeks rent that I paid after transferring the purchase price was a reasonable amount of time to allow for the legal paper work to be completed.

    You really need to get an answer from your solicitor.

    I’ve no idea how a purchase from a council is done - however I’d be asking questions from your solicitor as to how you can be on the hook for Mortgage repayments when you don’t own the property.

    Funds are normally only released by the bank when all the paperwork is completed - how were the funds released before the sale closed? Why would your solicitor have released the funds to the council before the deal was closed?

    I’m assuming the loan you got is a mortgage - but I could be wrong here.

    No, I didn't get a mortgage. It's a combination of a small personal loan, family loan, and savings. Nevertheless, the loans are being repaid weekly. My solicitor has told me that funds were transferred to the councils solicitors 10 weeks before I stopped paying rent.

    This is one of those things where you'd think common sense would apply. Someone in the council deserves a jobsworth award.

    Of course you owe the rent, you're still renting the house!

    If you've handed over money to them, you should ask them to deduct the rent from that sum and ask them to reduce the purchase price accordingly.

    You need to get your solicitor to ask this.

    I can’t believe that a solicitor told you to pay over the funds for the house without checking that all the paperwork was in order? Are you telling us all the facts OP?

    Yes, to my knowledge, everything is ready to go. Paperwork is all in order. The only delay now is the dispute about me owing all this rent that is constantly accruing.
