Bought car with wrong mileage advert

    Hi,Sorry probably asked before but my youngest purchased a car with incorrectly advertised milage.

    It was advertised as 114k kms but in fact that was miles.114 miles or about 183kms

    Now obviously first question you ask is why did he buy it if he wasn't happy with that unfortunately hes not really into cars and when he saw the 114miles on the clock he presumed it was kms.(import).

    This was 2 weeks ago and the tax book has arrived in his name.

    He loves the car but really has he any comeback or what do you think he should do.

    He wants to keep the car.

    Car was bought from a dealer but not main dealer but not a cowboy either.

    Worth a call to him or just let it slide.

    He has a copy of the advert .

    Not sure i'd let it slide, the difference means things like timing belt, injectors could be nearer to needing changing along with other parts so I would look for a gesture of goodwill off the dealer.

    What year is the car? And how much did it cost? You are definitely entitled to some compensation here

    I would definitely be looking for some form of recompense, it's not a exactly a banger he was buying. Have a chat with the dealer IMO.

    Is it an M-Sport or SE? If its an SE model he overpaid big time considering the mileage

    Not a big difference? Could equate to more than 4 years driving based on the average kilometres driven by motorists in Ireland.

    The car would not be that much cheaper with that mileage if not the same price. It's an annoying mistake but I wouldn't be to worried. Will get over 400k on that bmw easy.

    Are you being serious? Go check the price of a low mileage 5 series vs a high mileage one. Its literally thousands in the difference

    Going to be very difficult now to get any sort of willing compensation from the dealer I'm imagine, given the car has already been accepted and money handed over. Might be worth contacting the CCPC for advice.

    My take on it though is that it doesn't sound like the dealer concealed or mislead the correct mileage of the car itself when it was viewed and bought by your son, only incorrect in the advert itself. I'm no expert in that area though so again the CCPC maybe be better to give advice on his rights in this situation.

    I think you have a very strong case under your consumer rights as the goods were not as advertised.

    Goods must be:

    "as described, whether the description is part of the advertising or wrapping, on a label, or something said by the salesperson."

    Do you have a copy of the ad?

    Edit: The latest wording on the CCPC website is as follows:

    "A business must always sell you a product that:

    • is fit for the purpose it is normally used for
    • works for a reasonable time with normal use
    • matches what is outlined in your contract or any descriptions or samples you saw"

    As KM is the normal measurement and the car had been advertised with a certain number of KM the salesperson and all documentation would have to actively indicate that the number was not in KM and indicate the number of KM it represented. It isn't as if this is not a known problem.

    If the ad was a mistake, then they are entitled to say when you go along that it was wrong, but not to allow you proceed without telling you.

    how many cars are advertised on DD with mileage as KM when its actually miles. This is by garages and private sales alike

    Agree that most seller do this deliberately but once bought it could be v difficult to get anything back here

    I presume you have the add saved if it was on DoneDeal, because of the add is gone you might not have much of standing.

    I’d be looking for some good will gesture. Maybe timing chain change when it’s due to

    When you inspect the goods and agree to purchase them based on the inspection, what was in the ad flys out the window. This isn't distant selling, unfortunately and errors & omissions excepted is pretty standard as long as a buyer has an opportunity to discover any unintentional errors and should reasonably be expected to do so. E


    It's also fundamentally different to an order (imagine ordering a new car with LED lights and it comes with halogens, even if you accept the car before realising, it's a different scenario legally).

    Out of curiosity, what mileage was on the receipt/invoice you got from the garage?
