Sports Direct Return

Any advice appreciated. I bought a pair of New Balance runners from Sports Direct online as a Christmas present for my partner. I bought them in October as the model in question seems to be popular and is often out of stock. He always wears the same model of shoe by New Balance in the same size, so when I spotted them in stock I thought I'd but them while they were available.

However, the model in question had just had its latest release/version issued, as they often do, which is the one I bought. He had run in a number of the previous versions of this model, and has always been the same size. When he tried them on Christmas morning however, his usual size is too small in this latest version of the shoe. He just tried them on once, and they are currently perfect, unused, as new in the original packaging.

I've emailed Sports Direct and they are refusing to help in any way as I bought them outside their 28 day return/exchange policy. They weren't on sale, I paid full price and they are still that price in their online shop, at just under €170, so they aren't cheap. Is there anything we can do. I'm aware it would have been best to try them on when they arrived, but as they were a present and he asked for this model and size specifically (as his foot size hasn't changed) I thought it wouldn't be an issue.

Any advice that might help resolve this, or are we stuck with this pair of running shoes?

Because you bought so far in advance, you may not have any joy. 28 days is a reasonable amount of time for people to try on and test sizing.

You might have more joy if you bring them into a SD store, where the team on site can see that they haven't been used and are still in perfect condition. In fairness, online team wouldn't have any leeway but in store you might get someone a bit sounder.

If he's been wearing a size x in NB shoes for a long time and all of a sudden a pair is too small is it possible the new pair are marked wrong? If so you wouldn't you be entitled to a refund.

They have a 28 days return window. Twice the legal minimum.

This is plenty of time to try something on and with footwear size is not an exact science as it includes the fit (not just the length)

I wear Timberland. Some models I'm 11.5, some 12. Some simply won't fit due to the style and my high arches.

That's footwear for you. Trying to BS a fault when there is none will get you nowhere.
