Suing AirFrance. Does it worth?

    Hi All,

    Sorry for the long story! Hopefully it also helps people in the future.

    Had a flight from Dublin to South America via AirFrance. When I tried to check in with my booking code, it said it couldn't find my booking.

    I contacted their contact center and they told me the ticket wasn't issued due to a payment failure with my bank (BOI). However, I questioned them saying I was charged for the ticket. They then told me they refunded the money already and the issue was with BOI.

    Contacted BOI, they said nothing came through.

    Rang AirFrance back and they initiated a refund, got an email, then another email saying the refund was denied, rang again and they informed me that was rectified and they money should arrived in 2 weeks. Its been 4 weeks and nothing.

    On the top of that I had to buy a last minute ticket spending 200 euros more than the original ticket price.

    Does it worth suing AirFrance? Or will I just get my ticket money back after years in court?

    Or should I keep trying to contact them?

    Contact your card issuer and initaliate a charge back. They will ask for proof, forward on all of the emails.

    It's effectively just a refund but can be done without the businesses authorisation (dependant on the proof you provided)

    Had similar with Ryanair this month, money pending on my banking app BOI, flights on my app but no confirmation email. 24 hours later contacted Ryanair, told rebook flights as my booking was cancelled as payment failed, 6 weeks later the pending transaction left my app.

    Would cost you a lot more than E200 to sue them - solicitor's fees etc. What would you actually be suing them for?

    Just do a chargeback as already advised.

    Yep, definitely a case for the European supreme Court.

    Go for it.

    The damage to you is so immense it's certainly a million+ case.

    Weather says snowflakes expected.

    Chargeback is fine, but there was an extra cost to make the journey.

    If Air France received the money, which seems to be case, then a contract should have existed and they should not have denied you boarding. So I would seek compensation for that, initially from the airline.

    I'm being very helpful.

    It's totally and utterly ridiculous to even think of "suing air France" for above situation and it's quite helpful for the op to be told that very bluntly and put such ridiculousness out of their mind.

    The OP is trying to sue Air France over a payment issue. Honestly the reply from @JVince is justified.

    I've never had an issue on boards in over 14 years posting but this is exactly why people call out the mods. You need to chill with jumping on every post or there won't be any users left.

    The site is barely useable since the update anyway, don't make it worse, please.

    Edit: OP, unfortunately you'll get nowhere and it'll cause more stress and money than it's worth. Do a chargeback and move on. Avoid the airline where possible, that's honestly about all you can do.

    Honestly, my money is on this being a Bank of Ireland issue. Your credit card might be blocked. I would call them again to make sure.

    I don't think the response was really justified in a consumer issues forum. No need to bring up the supreme court and take the p*ss. The OP was simply asking if they should take legal action because some company allegedly took their money, didn't provide the service and has yet to refund it two weeks after promised.

    I don't think legal action should be taken at this stage, but it's a valid question what would be the next step. Frankly, I think the poster taking the p*SS got their definition of 'suing' from the sun newspaper.
