Apple iPhone warranty and consumer law

    Looking for a bit of guidance here. I’ve an iPhone that’s less that a year old, on contract with Vodafone. Faulty screen on the device.
    Vodafone not being helpful, and telling my I’ve to claim under the insurance, and it’ll be away for repair for three weeks. They really wanted me to go to Sandyford myself with it myself, rather than leave it into the store.
    I understand the apple warranty is one year, but is there an eu/Irish consumer law that covers electronics too? Is it two years, or six? Seeing various things online.
    Pretty annoyed that an iPhone 15pro developed a glitchy screen issue after only 9 months.

    Apple warranty is one year, EU/IE warranty is two years. Vodafone warranty is one year. EU warranty is two years. Tell them it's consumer law and if they deny it threaten them with small claims court and that you know your rights as a consumer.

    If it happened by itself within 9 months it's a fault with the device. Vodafone should replace it for you, not claim it under insurance.

    The 6 years irish law is a right to redress, it doesn't mean a 6 year warranty. It just means Apple or Vodafone have to support your device for 6 years, that means if it breaks they have to offer you repair or replacement, even if it's paid.

    Ireland did not enact the 2 year warranty. The protection afforded by the Sale of Goods Act is deemed to be stronger. With this you have up to 6 years to make a claim, it is not a warranty. I think if its faulty with the first 6 months the fault is considered to be a manufacturing fault.

    From the ecc website:

    My product is faulty what are my options?

    You can ask for a repair or replacement. If, however, the business cannot offer you a repair or replacement, you can ask for a refund. Under EU law, you have two years to take a case but it is important to contact the business as soon as you discover a fault.  You can use our template letter to help you.

    I presume you mean replace the faulty screen? I'm not entitled to a new phone, am I?

    Thanks for all the helpful replies.

    I have it left in with them now, but I'll follow it up carefully.

    I erased the phone via another device, but it's still showing up on the Find My Device app. She had told me to disable that, which I thought would have happened when I erased the device. But sure no way I could do that when I can't see anything on the screen anyway. 😂

    When you say faulty do you mean out of the blue faulty or accident faulty like dropped, cracked, water damage etc?

    No, it's out of the blue faulty. Most likely a manufacturing defect. It's not from misuse. 70% of the screen is completely glitchy. For the first while it would come back intermittently, then it came back fully, but then after a week it went again, and hasn't come back.

    Even when the phone went into screen lock, this section of the screen kept glitching.

    Sounds like a warranty thing in my book not insurance and I assume its with the retailer first and they'll have to deal with the manufacturer. Deliver yourself and 3 weeks sounds a bit shoddy too. I take it no replacement was offered either.

    OP your contract of sale is with Vodafone only deal with them as they’re obliged to repair replace or refund if it’s a fault with the phone.

    Don’t let them fob you off to a 3 party place either or back to Apple it’s their problem and under NO circumstances should pay or be billed for a repair or replacement.

    Always quote the sale of good and supply act with any correspondence with them.

    So having a bit of a nightmare with Vodafone. Went back in today to see if the issue had been fixed. They had my phone, but told me they haven't done any repair as find my iphone is active on it. When I was asked about this when I dropped the phone in, I explained I had erased the phone remotely, and they said that would be sufficient. Obviously it's not.

    They then told me I'd need to turn it off, and it would then take another few weeks to fix. I said I'd try a different authorised repair place first, and see if they could do it sooner.

    Went to Select, on King Street, and they said to come into them at 9am, and it would take 3-5 days.

    So came home, contacted Apple, and after turning off find my iphone, they said it remains active for 30 days, due to me originally erasing the phone remotely. And as I'm now past the 12 months, they've told me to deal with Vodafone only. So the repair will probably take until February.

    I was back in with Vodafone. Extremely unhelpful again. They tried to tell me it's nothing to do with them, and my best option would be to take it to a repair shop and pay to have it fixed myself.

    They reluctantly took the phone in to send off to their repair shop, Fonfix, in Sandyford. So I'm left without my phone for the next couple of weeks.

    Is there any way of walking away from them, and porting my number to another provider?
