    Who owns council land ? !

    When it comes to the sale (or disposal) of public land, it is mentioned in government guidance that:

     "Land and related rights in Council possession are, in effect, held in trust for the public."

    Law dictionaries state that 'held in trust' is "used to describe property held by a person who is not the owner but who is a trustee or an agent"

    So, do councils just hold the land in trusty but are not actually the 'owners'. Instead the public are the owners of the land?

    If anyone knows the particular Statute that defines ownership of public land that might help!

    If you are interested in how Local Authority land can be sold the sale has to be approved by a meeting of the Members of the Local Authority IE. Councillors.

    I think the key words are “in effect”. That to me is stating that a council is the definitive owner, but any use/disposal etc. of the lands is done on behalf of the public via decisions of elected representatives. Certainly, councils are registered owners in Land Registry and random members of the public have no rights that I’m aware of.
