Breach of planning conditions

A situation has occurred locally where planning permission was refused to 2 different people on the same site stating local needs reasons.

Along comes a local who has a house locally and applied on the same site. Further information is sought to prove a rural housing need at this location. Planning permission is granted. The house is built and has been put up for sale for an eye watering sum.

What can be done about this? The conditions say the applicant must occupy the property for 7 years. They appear to have wilfully deceived the planning department to obtain permission and a person across the road has recently been refused due to ribbon development

No why?

There's quite a few in the area annoyed about this. Can planning conditions be enforced?

It makes a mockery of the planning department who even requested further information regarding the housing need

Contact the planning enforcement section of the LA. Whether or not you made a submission at application stage is irrelevant.

Nothing, a planning condition that the house must be occupied by the applicant for seven years is not enforceable. I know someone who built under the same local needs scenario who sold 3 years later to a non-Irish couple for a holiday home.

The local needs condition is BS and should not be a part of the planning framework. Either a building is within the development plan or it isn't, who is building it should be irrelevant.
