Management company looking to install CCTV

    Can the management company install cctv to record people entering a small above shops apartment building.

    Yes.

    So long as the decision has been taken by the Directors of the Owner Management Company CLG, on behalf of all the owners and residents, and that the purpose is in the interests of same.

    In doing so, they become data controllers as defined by the data protection acts. They have related responsibilities regarding the collection, storage, management and use of the images they collect.

    They should also have a written policy regarding their data collection activities including information on how a third party can access their data and to whom complaints may be directed.

    There's no simple yes/no, but the first question would be - why would they need to do this? What is the purpose?

    The next pile of questions would be along the lines of - who will monitor? who will have access? how long will images be retained? where will data be stored?
