Summons for speeding with no fine received beforehand

    Hi. I received a summons by registered post yesterday morning (16th july 2024) stating my car had been caught doing 65kph in a 50kph zone on march 2nd 2024. It wasn't myself driving as I was 39weeks pregnant and I was lying on a hospital bed.

    I have been given a date for when to turn up in court or I could pay €320 and get 3 penalty points on my licence and the case would be dropped.

    I have checked on numerous websites and citizens information and it states I should have received a fine for €160 first to be paid within 28days and if that isn't paid it goes up to €280 to be paid within another 28days and if that isn't paid it's a summons and €320 to get out of the summons.

    I haven't received any fines in the post previous to this and if I did it would have been paid straight away because I'd rather pay €160 then €320.

    Has this happen to anyone else before and how did it work out for them?

    If you were not the driver as you were in hospital, advise the court as to who was driving, and let them take the hit.

    Sorry I should have said it was my partner that was driving so whatever the fine is we'll both be taking a hit realistically.

    I'm more wondering has anyone not received the fines first and gotten summons as first notice of offence and what happened with them.

    Had something similar recently for a company car. Once the correct driver details were provided, the clock reset and fine went back to the original.

    You might be both sharing the fine but one of you are getting 3 points on your licence so you need to choose who's going to court so need to work that out first.

    Thanks for your helpful reply. I'm gonna call to guard station and explain what has happen hopefully it'll go back to original fine.

    Obviously.

    I'd rather pay the fine then go to court.

    My point is I (I'm saying "I" because the summons came in my name) haven't received the first (€160) and second fine (€280) that I'm supposed to receive before being summonsed.

    I got a summons for no tax before, I hadn't received the initial fine and at the time I had no option but to go to court.

    I showed up, spoke to the garda that sent the summons and showed him my up-to-date tax. Swore the oath and explained to the judge that I hadn't received a notification for the initial fine, he said while I might not find this believable, you have given sworn evidence that this is the case and he struck it out.

    The point is, you either pay the increased fine or explain the situation to the judge under oath, your partner will most likely need to be there too with his license to receive the points.

    Also, check where your car is registered, it might be an old address

    A few years ago partner received summons for speeding, no fine notice ever arrived in post. Had solicitor in court, swore oath she did not receive it, judge struck it out. Solicitor costs €50.00
