    Hi all,

bought a phone as a Christmas present for someone but they had bought a new phone online in the meantime,I have the receipt and the box is untouched,I bought it less than a week ago but they will not take it back/refund me

has anyone else been in the same situation?

    thanks in advance

Did you buy online or in a physical shop?

    In the shop

Change of mind isn't a reason that Eir or anyone is obliged to accept a return for a phone purchased in-store. That some retailers do? Is great, but it isn't a consumer right.

Too bad. Distance selling might have saved you.

They're not obliged to refund you at all. Any chance of negotiating a store credit? Perhaps sell it on as an unwanted gift?
