    Hello everyone. What responsibilities does a landlord have when one of the tenants informs them about splitting from the joint tenancy? The remaining tenant intends to stay in the apartment, but I doubt she can manage the rent independently. Is this my concern as a landlord? Additionally, what happens with the deposit?

    Assuming the tenants have joint and several liability for rent, the remaining tenant becomes responsible for the full amount of rent. Typically the remaining tenant finds someone to replace the departing tenant, which shouldn’t be a problem in the present climate. If the remaining tenant can’t pay the rent, and the rent goes into arrears, expect a letter of termination from the LL.

    Deposits aren’t given back until the tenancy ends, either the tenant who is leaving gets the deposit from the new tenant, or the remaining tenant gives the departing tenant the deposit and gets a deposit from the new tenant.

    As the LL, you need to remind the remaining tenant that she is responsible for ensuring full rent continues to be paid, that will motivate her to find a replacement. If you aren’t paid full rent, give notice of rent arrears and begin the process of termination. Finding a new tenant is not your problem.

    The staying tenant finds a new person to replace who is leaving and the new tenant pays the deposit to the tenant who is leaving. If that makes sense.
