Currys/PC World ignoring me, summons them to Small Claims Court?

    I bought a fridge freezer from Curry's in 2019, it stopped working recently. I have 6 years under Irish consumer law and want to get it repaired/replaced.

    I complained to the shop 2 times and no one called me back or even attempted to setup a repair etc. I think the fridge is fubar and should be replaced but they have to at least try repair it under the legislation.

    I also emailed them a week ago and no response, the company in uncontactable as far as I'm concerned with layers of bureaucracy built into their phone systems designed to frustrate you and make you give up. The following day I bought a new fridge and put it in place from another retailer as my tenant could not live wthout a fridge obviously. It is over 1 month ago now since my initial complaint to this horrendous company. I'm considering the SCC because I feel I'm out of options and I won't play their perverse game of pass the buck.

    When you say replacement, do you mean with another 4 yr old fridge? If bought in 2019 you have to consider that you have used it for 4 yrs so it’s unlikely they are going to give you a new one, and unrealistic to expect them to. Also, it is up to you to confirm it is a manufacturing fault, have you had it independently inspected?

    Have you put your complaint in writing to their customer service department? If not you need to email customer.services@currys.ie with details of your complaint. Refer to your consumer rights & give them a deadline of 10 working days for a response. In the past 5 years I have made two complaints to Curry's regarding microwave ovens failing within 2 years of purchase & these were settled to my satisfaction by means partial refunds.

    An example letter of complaint can be found if you Google "CCPC letter of complaint template".

    you need to exhaust the complaints procedure with the retailer. then small claims court.

    I might be totally wrong here - does the SOGS act apply here as the purchaser is a landlord (business) ?

    They will have to try to repair it or if not possible they have to give a discount equivalent to remaining life from a new fridge. A fridge should last more than 6 years, so even if it's 4 years old you should be getting 10 years+ from a fridge so 50% off a new fridge if they can't repair it would be a reasonable solution.
