Does a previous employer have to send you back some payslips if you make the request ?

Hi,

I'm trying to get my previous payslips organized and realised I lost a few of them for something like 9 and 10 years ago.

I would like to know if my previous employer is in the obligation or not to send them back if I made the request?

if yes, is there a time limit to issue those payslips due to the GDPR?

Employers should keep payroll records for six years minimum. Don't count on it.

Why would you need payslips from 10 years ago to verify employment - that's ridiculous.

Please don't embarrass yourself by asking your old employer to dig out payslips from 10 years ago. They will think you are absolutely nuts - that's after they stop laughing.

That would be a no, GDPR requires data holders only hold data that is relevant to them doing business and to let you have a copy of that data. Employers from 10 years ago would have no need to keep copies of your payslips, so according to GDPR they should have been destroyed, but you might get lucky. For accounting purposes there may be some kind of summary data about your salary and payments, so you might get a dump of some kind of computer file if you make a GDPR request.

Ten year old payslips are not really of much use, perhaps if you tell us what you are trying to achieve, we might have some suggestions of work around...

Certainly, I'll promptly proceed to request the archival payslips from my previous employer – undoubtedly, they've been anxiously anticipating a whole decade for this pivotal juncture in their illustrious payslip-sharing journey!This could be a substantial move for them, considering the useless value they provided.

I was actually organizing my folders recently and carried out a significant tidying task, during which I noticed the absence of a few older documents. It's not a major concern if I don't have them. I don't currently have a particular objective in mind for requesting them. However, I thought it might be prudent to have them, in case there arises any need in the future to substantiate any professional activities during that period.

There is no point in proceeding any further i believe.

Qwerty honestly there is no need for you to store all this information regarding payslips. Im guessing you keep all your bills, banks statements etc too. You only need to really keep them for 7 years. Do you not have emails or contracts to support your evidence of work if you really need it? Im picturing your office or spare bedroom looking like this ( only joking!).

I don't think payslips are much use after a year, other than curiosity value. When you leave an employer assuming they gave you a P45 and an annual P60 they've got no obligation to supply copy payslips from years ago.

The important document to keep is the form P60, the annual record of Pay, Tax and PRSI payments. If you have various pension funds, from different employments, your pension provider may ask to see P60's for proof of those employments.

I was glad I held on to my P60's as some of my past employers do not exist anymore, so nobody to ask.

The previous posts are correct. GDPR rules would mean your personal data from a decade ago should have been securely erased and removed from systems.

Summary data would be somewhat useless too as it would just be corporate accounting.

There are jobs in certain sectors where it is important that your work history for the previous ten years is verifiable.

Employers in these sectors certain hold on to employee data for longer than 7 years. And it's quite legal for them to do so, because they have a valid business reason for keeping the data.

Now they might not keep the details right down to individual payslips. But they will have some very granular-level data, eg which patients you operated on, which accounts you updated, etc.

I missed a call yesterday from somebody that left employment in our company over 20 years ago, I didn't work there at the time and don't know her but apparently she is looking for some employment records. The lady that answered her asked her to send me an email but never received it up to now.

Wonder what she's looking for? She won't be getting it anyway !

What job sectors need to see your payslips for the last 10 years - Your talking nonsense.

Contracts would show your work history if needed or your work history can be confirmed by looking at the 'my account' service on revenue on line

I didn't say payslips, I said verifiable work history.

For one particular finance sector job, I had to provide written statements of service for 10 years, and was told that the relevant HR departments would be phoned and asked to confirm the details. (And of course to do that, the HR department must hold the records).

I have hands-on awareness of health sector jobs where there's a similar requirement to verify the last three employments, no matter how long ago they were.

Another good reason to hold onto payslips is to verify your pension contributions.
