    Hi all,

    So I am meant to start a new job this month. Passed the interview rounds, was given a verbal offer, eventually was sent the contract/onboarding documents last Thursday. Signed them and sent them back to HR with no issue.. or so I thought.

    This morning I get an email from someone, NOT in HR, but in a different (lower?) office role saying they need references. I had provided references, they say they can not issue the contract until the referees get in touch. Key word - Issue.

    But I have already signed the contract, and there is also a signature from one of the company leaders on it. I've already signed it, how can they refain from issuing it?

    The only thing I can think of is some sort of non-communication between HR and this person. Even still, I'm worried. They can hardly refuse to take me on just due to this fact when I've already signed the contract, can they?

    Help needed.

    Email HR directly for clarification. You were probably dealing with one person throughout the process, so get onto them and see what the craic is.

    They can let you go, depending on the probation terms of your contract.

    This is the thing. The Probation period part of the contract says nothing about referees. I haven't even started yet

    Generally they can let you go for anything during a probation, so it wouldn't be specific, though I know nothing about your contract.

    Just give them a quick call tomorrow and I'm sure there's a simple explanation.

    Have you read the terms and conditions of the contract


    Typically a contract does not come into existence until consideration passes, so you providing the work that is then paid for by the company so they could argue there is no contract currently in existence

    The second point to note is if you're employed for less than 12 months they can fire you without cause so long as it does not come under one of the 9 grounds of discrimination.

    The fact that you havnt commenced employment means you could only bring a claim under the equality act but you havnt claimed any discrimination.

    Is there a problem with references?

    To be honest that fact that you have signed a contract is probably of little consequence.

    If you want the job get them what they want.
