New Car Damage

    A good mate of mine had his new car damaged in an auto car wash, Garage reported it to their insurance, Insurance rang him and told him the damage was caused by a car part possibly a car aerial from a previous car. told him they will not accept liability until they try and trace the other car that lost the aerial to try a counterclaim. they sent out an assessor to view the damage which is almost 5 grand. surly with the garages public liability insurance they are obliged to sort his car, and it's not his issue with any other driver. I know Insurance companies will do all they can not pay out a claim but this is taking the mick I would have thought. I told him he should go to a solicitor.

    Any advice?

    He gets his insurance company to deal with it, they pursue garage insurance co, garage can try and pass it on.

    Your friends right of action against the garage is not dependent on a possible right of recovery against a previous user of the car wash. If your friend doesn't want to avail of the main cover under their policy, many have a separate extension for Legal Expenses. You can avail of this service to pursue your rights and it's not deemed as a claim under the policy
