Basis for constitutional and/or legal challenge to govt agreeing to Celtic Sea border

Many will have seen Bertie Ahern fly the kite of the Celtic Sea border between Ireland and the EU as an alternative to the Protocol in the event the UK scraps it.

What constitutional and/or legal challenge do you see possible to such a move? Is it a breach of EU treaties? Would it require a referendum? I don’t see how it is possible legally without change to EU treaties.
