Clause in planning

Hi, my offer has been accepted on a property. The house has been renovated and extension has been added. When I look at planning applications in relation to the property on line it says application was granted with conditions.

Looking for things to move forward to a closing date etc and the vendor has made contact saying that a planning consultant is now looking at a clause in the planning.

Would anyone have an idea on what this could mean?

It could be anything. The vendor will have to provide a cert of compliance and if there is anything amiss then he won't get that cert.

3-4 months if Planning Required to rectify.

Without knowing the details there could be a couple of outcomes. An opinion on compliance may be an option which would be qualified to cover a minor detail but this would in turn have to be acceptable to you, the buyer and the lender if applicable. If the planning consultant considers the non compliance issue too serious to certify then, as Gumbo said, it would take an application for retention to regularise matters.

If the vendor has an issue with planning clauses, that makes there position weaker not stronger. This is a problem for the vendor, not a gift.

Given the big increase in property prices over the last few months the deal falling through May not be a bad outcome for the vendor. Could well be lookin for an excuse to scuttle the deal...

If the offer has only just been accepted, then they've already benefited from the price jump.

If the offer was accepted months ago, there was likely a contract signed, in which case backing out shouldn't be a freebie.

In pretty much every single sale I have personally seen, or heard of(second or third hand), the contract is usually signed by the vendor just before or after they move out. Money is transferred, keys are picked up. Before that, as the purchaser you have nothing really.

It's the main reason if your purchasing, that you don't stop looking until you have the keys in your hand.

There's a few ways to do it. A handshake agreement, prepare in good faith and sign at settlement. Or sign a contract for sale at the time them the sale is actually agreed along with a deposit. With a settlement period for conveyancing.

Pros and cons of both. But the first does leave the buyer on a limb. But if that was the case, vendor could just do that. It wouldn't need to invent a planning issue.
