New Employer finding out about sickness

    Hi all, if I am currently out sick from my current employer with stress and in the process of moving jobs. Can my future employer whilst doing their due diligence find out that I was out sick with stress? Or is an employer check more in relation to start and end dates?
    Long story short do they have an entitlement to check of my sicknesses or if I am currently out with stress? And if they can would this make them change their stance of employing me?

    If you have passed interview stage your new employer probably missed the opportunity to find out about your stress.

    However, I would be very hesitant to hide an illness from an employer, it could mean that your position/role may be untenable if it's discovered that you were not honest in application.

    Is the new job going to less or more stressful than current job ? From my memory a new job is often more stressful, if you are able, happy days, however if you are not able to cope with new stress you face disappointing new employer straight away.

    If you're receiving illness benefit would your new employer not see it anyway when payroll comes around ?

    Your prosective empoyer could ask and some do. If asked, then while your current employer should not disclose your sickness and associated absence, they may do this in a deliberate or accidental way (malicious or non-malicious).

    If you are concerned, and particularly if reference checks are pending, it may be prudent for you to remind your employer that your illness and absence associated to it are sensitive and confidential, and you expect that they will not disclose same to your prospective employer. I would fall short of anything more than that as it is moving into threatening.

    Realistically speaking, contrary to one reply above (but with respect to the person making it), I would not disclose the illness unless it impedes your ability to conduct the duties. It could easily result in your offer, if you have received one, being rescinded. There is no lawful requirement you disclose health issues to a prospective or indeed current employer.

    Though you could disclose it and find them extra supportive! But that wasn't your question.
