Inheritance query - mother intestate

    Hi all..just looking for a bit of legal discussion..

    What's the story if your mother dies before your father without a will.

    I know her estate is intestate and the Rules of Intestacy apply but what constitutes her estate.

    Let's assume the mother had a number of shares, a life policy and bank accou T in her own name only.. Which we understand is divided on a 2/3rds, 1/3rd split between the father and children.

    But what happens the family home which is registered in the fathers name only, as are 2 bank accounts and a post office account into which the fathers pension was directly lodged to.

    The question is do any or all of these also form part of tge mothers Intestate Estate?

    Do you mean that your father survived your mother and is still alive, or that she died before him and then he died before her estate was sorted?

    Hi there.. She died in 2009 and he died in 2012.. We were told that her estate was under the Probate threshold and did not require probate.. And was admisitered in 2016. They were also joint directors of a Limited Company.

    On the facts you give, none of these assets ever formed part of your mother's estate.

    Ok. If the home and bank accounts were solely in your father’s name then they wouldn’t have been part of her estate at all.
