Hi all, I'm hoping someone can help me with a query.
To cut a long story short i made a mistake and was disqualified for 2 years. This happened about 3 years ago. I emigrated with no intentions of returning as i was having a tough time in Ireland. Im back now due to the declining health of a family member and will be here until they pass away. I have found my old license in some of my old stuff (as i never posted it in or turned up to court), i paid the fines etc as it was a mistake on my part. My question is do i need to apply for a new license or would i have to send to ndls to get “marked” that i had conviction or how does it work? License is still in date, thanks in advance

Afaik if you never submitted your licence or turned up in court, your 2 year ban has not started.

If i had lost my license would the ban not start until i renewed it or until it went out of date or how would that work?

If you mean lost as in misplaced - yes, I believe that's the case. You would have had to take out a new one, and then hand in the new one for endorsement.

If you are to be disqualified for reasons of penalty points, and didn’t hold a licence for part of the period of time, it works like you describe.

From the OP’s description, it would appear that his disqualification is as a result of a consequential or ancillary disqualification order under the RTA 1961 which actually doesn’t necessarily require you to even hold a licence. There is now a separate requirement to surrender a driving licence.

It is likely that this period of disqualification has ended, but I see mention of not appearing in court. I would suggest contacting a solicitor practising in the district court involved to establish the facts and advise on the matter.

Contact the ndls and see can you renew. Is it a learner permit, if yes you must do within 5 years or you will be reset and have to do theory etc again.

    This is complete nonsense.

Not according to the section under surrendering your licence... Not nonsense at all.

Yes it is. The surrendering of the licence is separate to the disqualification. Your disqualification will begin 14 days after you are convicted unless you ask for a different start date. The starting of the ban has nothing to do with your license being received.

It doesn't say anything like that, apart from the fine for not surrendering the license.

If the disqualification didn't start then the op is not even banned from driving going with this logic... Until he surrenders his license. Is that what you are saying?

There is now a requirement to surrender your licence, should you be disqualified from driving and incidentally a very poor compliance rate with same.

But this is entirely unrelated the disqualification order. I.e an individual’s failure to surrender a driving licence doesn’t nullify a disqualification order or delay its commencement.
