WFP and shared custody

    A couple are separated, soon to be divorced. They are amicable. They have one child and share custody. Typically 60/40 time at each house, sometimes 50/50. No maintenance paid and both parties in agreement with same, they share expenses for the child who is of school age.

    One is the highest earner, has custody 50-60% of time and claims additional tax credits. The other is lower paid, slightly above minimum wage. Can the lower paid parent claim Working Family Payment?
