Garda Cars With Cameras Question.

    The Gardai have camera's on their patrol vehicles. If a Garda car drives past any place today , when would the Gardai be obliged to have that video until ?


    I won't be engaging in the discussion of the ins and outs of everything, I think the question doesn't require me to.

    They are not obliged to have the camera on at all times, and there is no legal requirement to retain any recordings, unless it has been requested by "somebody".

    If the Gardai had video recording which showed them to have travelled on the wrong side of the road before swerving quite close to a cyclist , would a Garda or Gardai be guilty of an offence if access to the video recording was prevented from taking place before the cyclist made a request to a court judge for access to the video ?

    You are making the assumption that the video exists in the first place, if there is no proof of a video existing, how could a Garda be guilty of tampering with evidence ?

    Once a complaint was made or an investigation began they are obliged to gather and disclose all evidence (braddish v dpp)

    Prior to that, at the time of the incident, if the cops were aware that a crime /traffic offence had occurred and they then suppressed or deleted evidence deliberately then I think there is a common law offence of perverting the course of justice. But I could be wrong on that.

    As above though don't think irish cops have dash cam.

    You are making the incorrect assumption that they have video in the car. It's unlikely.

    Actually I'm unsure if any cars have full on dashcams. Anpr I don't think is constantly recording is it? (Never used a car with it so I don't know). There's an issue with dashcams and body cameras for Gardai because of the surveillance act wording so I'm going to say no, there's no dashcams.

    Gardai have a duty to preserve evidence. If it's their own evidence then they should lose the case and possible subject to internal discipline

    I'm guessing from your original post that you are the cyclist, you have complained about Garda action, assumed you knew there was footage. The Gardai have said there isn't and you now want to take the next step of having them disciplined / sacked / charged.

    I'm only making the assumption for the purpose of asking the question. If it actually didn't exist then I know there could not have been any offence .

    I thought they only used the camera to record an actual speeding offence where it would capture the image of the car and actual speed shown, I've never seen any official Garda video recorded from a Garda car used anywhere in the media here.
