Taking a civil action for compensation in a District Court

    Hi all,

    I'm looking at taking a civil action against two people who vandalised my property.

    My CCTV captured them doing it (I have the recordings which are in HD and clearly identify the two people) and the Gardai have confessions from them so the criminal side of things is dealt with but they have refused to pay for the damage so I want to pursue them via a civil action. It's about €4,500 worth of damage which I have receipts for so my understanding is that's within the monetary jurisdiction of the District Court.

    I'm conscious that a successful civil action doesn't necessarily mean I'll ever get the compensation or it could take a long time if they are unemployed and can claim not to be able to pay etc so I'd like to run the process myself rather than spend money on a solicitor which may end up just increasing the amount I never get.

    Any advice on how pragmatic it is to DIY this? Is it even possible? Am I required to go via a solicitor? Am I wasting my time?

    You do not have to employ a solicitor, but most litigants do so - for a variety of reasons

    It would probably be helpful to have a solicitor represent you. Shouldn’t be a huge expense. Based on your account, there is little contest. You are just looking for a judgement. Has the criminal element concluded and conviction secured? Is the €4.5k fair and reasonable?

    Are you have rightly pointed out, if there people have no means other than social welfare, and no prospect of that changing, you may have to consider the value in pursuing this.
