Need advice. Employer avoiding me /wages

    Hi.

    My boyfriend has been doing a bit of online marketing work for a company in Dublin.

    Its all online work, based on Instagram etc.

    Its commission so you're paid for each client you sign up.

    His payment was due to be sent around May 15th.

    The guy/boss was taking ages to reply, now the last thing he said was 'it should be in your account this week' (that was last week)..

    Now, he isn't responding at all.

    The actual company page are ignoring all his correspondence.

    Please help with a convenient way to approach this that may see him get paid ASAP.

    Or a good way to convince or 'scare' them into paying. Using words of course :V

    Sounds like he may be a freelancer working on commission - hence self-employed.

    So, for starters, has he an employment contract? And what Class of PRSI does he pay?

    Hi, thanks for response.

    So, unfortunately...

    No there is no contract. They were telling him he was on a trial basis and funnily enough he wasn't added into the 'marketer online groups'

    He hasn't paid tax yet as he hasn't been paid yet.

    And he's not registered as being self employed.

    Could we technically make a statement to the Gardaí considering its a service he provided that he hasn't been paid for?

    Like if someone done work on your house and you didn't pay them.


    Along with screenshots of proof of conversations, talks etc and work done.

    And he is going to call the guy he is in contact with today. Can't see him answering.

    It has just been text and email based.

    They are looking at and ignoring other correspondence emails and messages.

    Could we technically make a statement to the Gardaí considering its a service he provided that he hasn't been paid for?

    Along with screenshots of proof of conversations, talks etc and work done.

    Knowing the Gardai I doubt they’d get involved.

    What would you expect the Garda to get involved in a civil matter???? Obviously knowing very little about the Garda, we can assume.

    No, these are civil matters on criminal so there is nothing the Garda can do in this case or.
    Along with screenshots of proof of conversations, talks etc and work done.

    And he is going to call the guy he is in contact with today. Can't see him answering.

    The problem is you don't have much to go on for a start...

    Maybe start with verifying that the company and the contact do in fact exist:

    - Google for the company and see what people are saying about it, is there a telephone directory entry for it, can you find any pictures of the office on the net etc...

    - Google the person, see if you can find profiles on linkedin etc....

    - Do they maybe have a twitter account where you can contact them?

    Assuming they do in fact exist, then is going to be a question of what it will cost to take legal action and that depends on the amount due..

    If they exist and you have all your documentation then you can go through the small claims court (Irish/EU) process

    Yes, it 'exists'.

    They have good reviews and seem to have a decent reputation too so can't understand why they would avoid paying.

    They also confirmed the payment would be made and confirmed they were receiving their payment from the source too, so it's not like they don't have the funds.

    It's based on someone working for an online company, being paid as a marketer.

    Don't understand how that is not a wages question.

    Just because there's no contract doesn't mean it's not of topic.

    He's working for this online company recruiting their clients and marketing.

    It is the most relevant forum for the issue. ;)

    No, this isn't a criminal matter.

    If the guy doesn't want to pay you, you won't get the money.

    The legal costs would likely be significantly higher than any monies owed.

    A long time ago I worked in credit control. My advice is to ring the company every day asking where is the money. They may eventually give in.

    This includes ringing his mobile phone at odd hours, etc.

    You must do it every day so they know you aren't going away.

    But you earlier said

    To verify this, if he checks his latest Tax Credit certificate then it should show whether or not he is registered as having an employer.

    Update here:

    They paid out this morning!

    The power of Facebook/Instagram.

    Eventually found out the guy he was dealing with was a fake name and was actually the 'owner' hiding behind a fake page for some odd reason.

    We wrote multiple bad reviews with the names of the people in charge etc

    They weren't long about begging him to take the reviews down, and they sent a screenshot of payment then. Happy days.
