What does it mean if a social housing exemption order is granted?

    I'm just wondering if knowledgable folks here have any information or can advise me on what it means when the council issues a social housing exemption order?

    I know it means that they give up their demand for a percentage of social housing or land use, but if it is granted - does that mean it is granted permission for the build as well or do they have to apply seperately for that?

    Im basically living next door to a place that has plans for a four story appartment block and it came as a surprise to me that anything had been granted in relation to it.

    I was aware of an application to demolish the existing buildings and that was granted.

    Then another application went in with the text "SHEC: Demolition of existing buildings & construction of 2-4 storey apartment building to accommodate 20 no. apartments."

    Under that it says:

    Decision: Grant Social Housing Exemption Cert

    There is a shadow analysis report given with the materials on the councils website that goes up until 3pm in the day. The purposeful omission of anything after that suggests to me that there is going to be a dramatic impact from the four stories on the surrounding properties.

    Just to be clear, I support social housing and its badly needed, four stories really arent all that insane for the part of the city I live in either for that matter - but does this Social Housing Exemption Order mean that the development is going ahead and has been given permission by the council or that it is now entering a new phase of the planning process where observations from local residents can be made? For instance, I will have no acces to maintin my gable wall from looking at their plans.

    It's especially a surprise given that any time I checked the council's website there were no documents there and suddenly its granted and drawings are up.

    I basically feel that local residents were afforded no real opportunity to discuss or engage with the issue.

    It means the developer doesn’t have to provide any social housing as part of the development.
    It’s a separate application to the planning whereby they submit a statutory declaration declaring their development interests in the land and surround,Int land over that last 10 years or so.

    It doesn’t mean they can build anything. They have to lodge a planning application after the SHEC is applied for.
    The reason for the shadow up until 3pm is that is the critical times. They have to show it at high sun, low sun and that’s only twice a year. Somebody else may be able to explain that a bit better.

    The fact they applied for a SHEC means no social housing will be offered to the council but that won’t stop the council from buying or an approved housing body buying the units.
