I parked up in Newbridge, APCOA

    Looking for some advice. I parked up in Newbridge (at the River end of Eyre Street). There are no markings on the road, outside the house on the corner, to suggest it's part of the pay and display. I took it that it was a part of the residents parking so didn't pay. Naturally, I got a ticket from APCOA. [Images here]

    I appealed it, but just got a bog standard letter response without any explanation as to why they disagreed with my appeal.
    Just wondering what you all think, Pay it or fight it?

    The parking spots are clearly marked and your car is clearly not in a parking spot

    You’re parked opposite a poorly maintained single white line, did you mention that in your appeal?

    To me the parking bay road markings behind you seems to suggest that you are indeed in a parking bay....if the space behind you was the last parking space then surely the road marking indicating the outer edge of the space would end at the end line.....

    Edit - that junction looks newly surfaced, are you sure that the road marking indicating the last bay hasn't been forgotten to be reapplied following the works?

    Agree with decoda, submit those photos on appeal. You were parked correctly, resurfacing is quite obvious and has removed parts of the parking bay lineage.

    Parking spot is not correctly marked.

    Looks like road works were done and they never but the line markings back on the road.
    That's the councils problem, not yours.

    You can see from the older image on google maps that there was indeed a parking spot there and they just never put the line back (Note they did put the white line in the centre of the road back, some of the way).

    Small claims court is the answer here, if you've never parked there before and didn't realise the council considered it a parking spot.
    However if you park here all the time and are fully aware that this is a parking spot prior to the road works being done and were just chancing your arm, then I'd just pay the fine and leave it.

    Surely it's not my job, as a motorist, to have to figure out what's underneath a resurfaced road? If the KCC managed to put down fresh double yellow lines, a central median line and the junction markings, then making lines for parking bays would also have been done. I took it that this area was residents parking for the houses on Canning Place.

    No, it's illegal to park opposite an unbroken white line and in your original picture the car was partially opposite one.

    Also, the bar across the top of the parking line extends both sides of the perpendicular line indicating that it is P&D on either side of that perpendicular line.

    Are you actually a resident ? Anyone who frequents the town will know how hard it is to get away with parking illegally so if you are a resident i'm surprised you tried it.

    This coming from someone who was clamped by APCOA in the town :D

    Also, the bar across the top of the parking line extends both sides of the perpendicular line indicating that it is P&D on either side of that perpendicular line.

    not if you're in a marked bay which he would be if they hadn't deleted part of it with roadworks.

    so either they parked opposite an unbroken white line or they were parked in a bay and didnt pay. Either way pay the fine and move on.

    APCOA are a private company, no? If they issue a fine (unless it's under KCC authority with relevant bylaw) ignore it
