Bench warrant

    My other half has been away for four months travelling. A summons arrived in December for a court date for possession of a bag of weed. He obviously wasn’t here and missed the court date and so now there’s a bench warrant out for his arrest. Gardai have called to his house twice despite his parents explaining he’s away.
    He’s coming back end of the month and terrified he’ll be arrested in the airport. But leaving that aside what does he actually have to do upon returning home and who does he explain to that he’s been out of the country and wasn’t intentionally ignoring the summons or warrant?
    Any advice appreciated

    What did the Garda / Court say when he contacted them about this to advise them of the circumstances and reschedule a date for his hearing?

    No trees were harmed in the posting of this message, however a large number of electrons were terribly inconvenienced.

    Get him to ring the Garda station that is trying to arrest him, tell them he's away and he is back on the "Date" and he will present himself at the Garda station the next day, or if the Irish government are in a hurry to arrest him he'll return if they provide the means to do so.

    Hasn’t contacted them. Parents have twice. Should he before returning?

    OP, outstanding bench warrants are best dealt with by arrangement. Since there's a criminal matter at the start of this, your other half should consult a local solicitor who practices in criminal law. They'll be best placed to deal with the matter.

    It had happened way way earlier last year and he forgot about it. he didn’t skip the country to evade anything it’s not a bank robbery ffs :)

    He should make contact with the Gardai and have his flight details and proof of booking readily available (so as to be able to demonstrate that he had left the country before the original summons was served and that the booking was made some time prior to that). Ideally he will also be able to explain why he's been on an extended vacation (so as not to arouse further concerns).

    After that he should arrange to present himself at his local Garda station at the earliest possible opportunity. And he'd be barking mad not to shell out for some legal advice from a specialist at the same time.

    He must be some lad that he forgets he has a court date pending and in the year 2020 can't figure out a way to contact the police.
