    Hi, just looking for some information if anyone had any to give.

    I was stationary 2 weeks ago and a car hit my wing mirror and took it off. I followed the car up the road and caught it in traffic where i beeped the horn and the man got out, he suggested parking on the kerb which we did.

    I got out, took a photo of his number plate and he got extremely aggressive, i told him i had a small baby in my car and if he continued to roar id call 999... i did this, and told him i was taking a picture of his insurance he tried to swipe my phone out of my hand and said he was leaving so i stood on the drivers side to stop him from driving off, he ran me over.

    Turns out hes not the registered owner of the car, and now i think of it i doubt he had any insurance at all. The whole thing was caught on cctv which the guards have. They had intended to charge him with hit and run, leaving the scene of an accident and some other charge.

    Im left with 900e for a new wing mirror and a broken foot and soft tissue damage to my ankle.

    I am meeting the guards Wednesday to give a statement, and they have flagged his reg but before i go in blind is there anything i can do to recoup the damages to my own car or what would be the guards next step..

    Notify your insurance

    If he's no insurance then the eventual claim will be through MIBI - through your insurance. A photograph of his number plate and a call to the guards would have been the wiser course.

    You have done what you need with the guards OP, now notify your insurer.

But im sick to death of people who break the law and think its ok, i pay all my insurance costs and watch them hike up ever bloody renewal, and then you have this git who doesnt bother his arse, and then ive to pay, he was near 70, wouldnt you think at that age a bit of cope on he might have.

    Keep on the Guards, IMO intentionally driving a car at someone should be an attempted murder charge but the bar for that crime is so ludicrously high it's almost impossible to convict. At a minimum it should be charged on the high end of assault with a weapon leading to significant jail time, this being Ireland unless you push expect it to be glossed over entirely that it was more than just an accident.

    They can be quite expensive these days if they are power folding and/or auto dimming and have led indicators or puddle lights built into them.

    That's only the start of it... Some now have GPS receivers and ultrasonics built in.

    In any case OP, push the Gardai for a serious assault charge. This wasn't an accident, and a few centimetres more could have meant you may never walk again.

    The photo of his number plate proved fruitless, the guards went to the registered owner and it wasnt him, he obviously sold the car on and gave the logbook, i dunno

    It's even expensive for fairly ordinary ones especially if you go genuine....

    Indicator built in, heated mirror with genuine glass, arm and housing and then the colour coded cover oh and fixing bolts.

    He did it because the consequences are worth the risk. Look at what is going on in our judiciary. He'll perhaps get a suspended sentence and suspended licence. It's wrong and of no real benefit to you. No real punishment there for a 70 year old man. Plus he's already shown form in that he tried to run you over. Do you want this man knowing anything further of your personal details?

    The is a site you can type the Reg into to check if and when the car was sold.

    The owner of the car may have loaned him the car.

    I would bet any money he knows who was driving that car. Probably someone banned and related to him. If I sold a car I always send the book of myself and if I didn’t and the person who took the car didn’t send it off themselves, I would be back onto them and also I would notify the department of transport to get my name removed. In all likely they know each other . I would be looking to find out who the registered owner was and then I would do some online snooping to find the match .

    But it would have allowed MIBI to do their thing without you being injured. Don't get me wrong I understand the want to hold someone to account but as you've found out some people are arseholes and will do anything to avoid paying out a few quid. I hope the guards get the guy and he gets banned.

    I put in the reg but it just says no change of ownership in the last 3 months, doesnt throw anything else up.

    The owner of the car obviously loaned the car to the guy.

    It should come out of the owners insurance in that case I'm sure.

    How did the Gardai identify the driver?
    Did they recognise him from your CCTV and photos, suggesting he's known to Gardai, or follow up with the car and find the owner or someone else who identified the driver?

    If I was in your position I'd prepare my statement as soon as possible after the accident so every detail is fresh in my mind. When giving statement to Gardai I'd emphasise that he deliberately drove into you to cause you injury so that this serious crime is not treated as a mere accident.

    If you got insurance details from the car then put in a claim with that insurer. If the driver wasn't covered then it's up to the Insurer to confirm it, rather than you being left to second guess yourself. The Insurer certainly won't resent notification of an accident involving a vehicle it covers, not least as it may be Insurer concerned if the case goes to MIBI.

    When i took the picture of the number plate he tried swipping my phone, i started to make my way towards the front to take a pic of insurance, there was something in the window but i dont know if it was insurance or fake or just none. He hopped in his jeep then and tried to drive off.

    I put the reg into the nct site and on the car theres an nct due next month!

    I gave a description of him and the car along with the picture i took of his number plate with half him in it actually ( just not his face)
    It wasn't my cctv it was the village cctv ran by the guards that caught it and they never said anything about him bar the accident is caught on cctv. The gaurd dealing with it said "ive called to the house and the regiatered owner is not the driver, the car has been sold".. i think thats bull but i dont have an address for the registered owner so i cant exactly drive by and see if the drivers knocking around also. I wrote my statement while i was in hospital, and ive added to it so i have that ready. I think the guards are dragging their feet, i found it very very upsetting that they left me on the side of the road with a 12 month old baby, im in tears and they couldbt even wait until my husband got there minutes later, they did ask did i want an ambulance alright

    Ask the Gardai for the insurance details of the other driver or car. Report the accident to MIBI.

    If you feel the issue isn't being dealt with properly bring it up with your local politicians. Councillors regularly meet local Gardai and may push your case if they smell a vote in it.

    Keep a copy of your own pictures and other evidence somewhere safe in case the Gardai lose theirs.
