Grievance response time

    Hi,

    My other half has raised a grievance due to being treated unfairly while on maternity leave as well as her role changing to less favourable terms when she will return to work.

    She informally sent a mail to HR who did not do anything to rectify the problem, we then went to a solicitor and sent in a formal grievance letter by post and email. This was over a month ago now and there hasn't even been an acknowledgement of the letter. The job has contacted her since the letter to see when she would be back and also asked about moving to a sales job with more money that she is not interested in as she does not like sales.

    The solicitor we have is a nightmare to get a hold of we have mailed asking but he takes forever to get back to emails. Should she resign and make a claim for unfair dismissal as well as being treated unfairly or does she need to wait longer/send an appeal?

    Suggest you demand a meeting with the solicitor or else go elsewhere.

    Resigning is a bad move IMHO unless there is a tempting job to go to, constructive dismissal is a complicated area. If your solicitor is crap then get a better solicitor.

    Thanks for the response! Any idea how long she should wait with no response to the grievance to send an appeal. Solicitor is good just a nightmare to get a hold of plus he already sent the first lesson so hassle of changing.
