Probationary Period ended

    Began a new job on the 30th September and signed a 3 month probationary period contract I have been working through Christmas but have yet to be told whether I’ll be kept on .

    I’m back at work Friday should I broach the subject to management or let them approach me?

    3 Months seems awfully short, are you a professional? Standard is 6 and sometimes 12 months.

    But yeah say nothing.

    Just a update met with management on Friday to discuss terms of extending probation however we couldn't agree terms and was in the best interest of both parties to leave.

    As I was there for under 13 weeks and still under probationary period I approached management at end of day and said I would no longer be continuing my position. We shook hands and parted on good terms.

    This morning I contacted the manager and asked him for a letter stating I am no longer employed he said that's fine but asked me to hand in a 'letter of resignation' .

    Is this standard practice as essentially my probationary period ended on 31 December and I was not under contract on Friday 3rd January?

    You're under contract until either the employer terminates your employment or you resign.

    The employer is not terminating your contract. You have verbally confirmed your desire to leave so it's up to you to resign which per the terms of your contract will likely require same to be in writing.

    Usually if the probation period ends on a certain date, and you do not hear anything one way or the other from your employer, then you have completed the probation period and are from then considered a 'normal' employee.

    No sounds about it he did resign, I think he completely misunderstood what probation is. He can't get the dole for 9 weeks now.

    Send him a letter that states your last working day, with something along the lines "further to our discussion, as my probation period has ended with no offer of permanent employment my last working day shall be 10/1/2020" or whatever...

    Regarding signing on, whether your probation period was extended or not there was an offer of continued employment and you chose not to take it.. so you are resigning (in my view anyway).

    Had 2 meetings with management on the day in question they approached me first to discuss things and we then had another meeting later in the day to discuss things more.

    I am on a disability payment and one of the reasons why we both agreed to cease employment was due to health issues which reared their ugly head again.

    So... you resigned? There's no problem at all in your writing a letter of resignation.

    They're probably being very careful. They need to thread carefully if you're on disability that they don't discriminate.

    But that's not the case is it? When probation ends you aren't offered permanent employment. Your permanent employment started day one of your probationary period and unless the employer uses the probationary period to decide they don't want you employed your contract of (permanent) employment simply carries on when the probationary period ends.

    It's very unlikely any legit employer will agree to or put in writing anything which might later be inferred as them using the probation period to terminate your employment due to your disability. There's only downside for them in such a situation hence the old saying, "No good deed goes unpunished".

    It sounds like between the two parties (you and the employer) you were the one who suggested a parting of the ways not them. IMHO unless they have given you a written notice of termination (for whatever reason) it's up to you to resign if you no longer want to be employed.
