SWA + Arrears

    A family member recently had their pension means test reassessed and in the interim received SWA of €60 pw. They were awarded the full pension about three weeks ago. I looked through their slips (with permission) and can see that they are both continuing to receive the SWA and also that it wasn't deducted from the arrears received. I've told them that they absolutely must contact the CWO (or whatever they're called now) about continuing to receive the SWA payment but should they also anticipate that the excess arrears will need to be repaid or is SWA not counted against arrears?

    Yes, any SWA paid to your family member in error while they were getting the pension will need to be repaid and any money given while they were waiting on the pension should be deducted from their back payment. It's important to make sure that the CWO gets any money owed back, as eventually they will look for it.

    Thanks for your response, as I suspected. They want to repay as well and not have it come back on them down the line. I'll tell them to go see the CWO asap, hopefully now a bit clearer as to what the situation is. Thankfully I was suspicious that the arrears were too large from the start and they put it away and didn't spend it while everything was figured out!

    We got caught some time back in the same situation but the issue was that SW had made a catastrophic error and we had no idea how much our back payment was supposed to be. When we got it, we received a letter saying any money owed to the CWO would be taken from our back payment and it was over a year later when we found out they had "forgotten" to do it. Definitely get them into the CWO as soon as possible to make sure, as SW can be quite ruthless once they realise they're owed money!
