Plans that council have wrong

    Hi all,
    I do hope someone can help me !! We are currently selling our house. It was built in 1979 on a council site with a council mortgage. The problem is we did not have a cert of compliance so we had to go to the council and get plans, did this and the engineers came out to find that the internal plans are way off, with minor differences outside but dimensions are the same. Now in order to build the house we needed a mortgage which was a council mortgage and the council needed to sign off the house according to the plans which was done . My parents do remember changing to the plans and resubmitting these because side windows had to be removed, thus moving all bar one bedroom upstairs. I cannot afford to apply for retention plans in time or money. I have applied to the housing department for the mortgage file and see if maybe it contains plans or the council engineers sign off. The council are adamant that they only have the plans given to us, but we already know that the folo for site is way off and this means that the eight others houses are way off so the site numbers are wrong but I cannot get any help from the council. Any ideas really stuck !!

    Something not right here.
    When the Council built it, it should have been Planning Exempt (Part 8) or something.
    So the Council should have signed off the build back then.

    Did you carry out the changes after it was signed off?

    No all changes were carried out prior to build. It is mind blowing I have two reports to state that the county engineer signed off twice for draw downs of the mortgage.

    Regardless of what was done or who changed what or signed off on what, the fact of the matter is that the house was not built in accordance with the planning consent, be it Part VIII or otherwise, and the only way to regularise the situation is to apply for retention.

    the planning issues may be the least of your worries if the land folio shows the wrong site

    The only point on that is that I have two reports stating that the build does meet plans for mortgage draw down

    Thankfully the council have amended the folio for the 8 houses
