Leave money to my dog

    Can I leave money to my dog in Irish law. Not directly, but for the care of my dog. The rest of it not released till after my dog dies?

    I wouldn't know about that but you can get a Canine Care Card from Dog's Trust which will ensure that they care for it & rehome it. You could always make a legacy to them to cover any costs but this isn't mandatory.

    I asked dog's trust to help me rehome my dog as I have stage 4 cancer and they were completely useless. They cherry pick the easy to rehome dogs and don't care about the rest. I said my dog needed to be in a kennel by herself and that was it they said they couldn't facilitate that at all. I went with a local shelter in the end and Spudsy got a new home with a lovely family who were looking for a second dog.

    You can't leave money to your dog; animals can't own things.

    But you can leave money for your dog. There's a couple of options.

    First, you could establish a trust to care for your dog, and leave the money to it. You can provide that any funds left over when your dog dies are to go to, e.g., some other animal charity. That's kind of a rolls-royce solution, though.
    The costs of setting the trust up and running it are quite high. Plus, it requires you to find someone willing to act as trustee and take responsibility for spending your money on the care of the dog. They themselves get no benefit from this, other than the warm glow that comes from looking after an animal.

    More simply, you can leave your dog to Joe, plus some money, on condition that he undertakes to care for your dog for as long as it lives. With this option the money is Joe's, not the dog's. There's no particular commitment to spend the money on the dog; Joe can spend it how he likes. If the money is all spent, Joe still has to care for the dog but, on the other hand, when the dog dies, Joe still gets to keep any money that hasn't been spent.

    It's up to you to identify a Joe, obviously, who you trust to care for your dog. In practice, with you dead, there will be no-one around to enforce Joe's duty to care for the dog. So pick a dog-lover, preferably one who already knows and likes your dog.

    Any arrangement will rely on how well you can trust & rely upon the designated person to look after the dog. Any individual may find their own circumstances changing so I would prefer to rely on an organisation.

    I have known Dogs Trust & their founder, for decades. I have a Canine Care Card as do my friends & neighbours. I accept that they will decide how my dog is kept & where it's rehomed. They have a system that rehomes over 3000 dogs per year in Ireland & ten of thousands in the UK. It clearly works & I accept that they can't make exceptions for my dog. Once he is handed over it's up to them to decide what's best. I believe their commitment that the dog won't be put down & I trust them to find him a good home.
