Debt Collection - District court

    An ex friend racked up 9875 in debt for not paying his portion of the rent. He moved out without giving notice to myself or landlord. Also came back and stayed for a few months without paying rent.

    During our friendship I also loaned him 2000 to pay off a loan (a literal life or death situation). Which we did sign contracts for and him using his car as collateral.

    Initially I just wanted for the months he stayed but a barrister said to me that doesnt matter he owes me for every month since he gave no notice. I've sent demand letters and he is making it difficult for me even blocked me from getting in contact. I've made up my mind to take him to the district court as suggested by the barrister.

    What are my chances of winning this?
    Had anyone ever been to the district court if so what cam I expect.

    Even if you get a judgement has he any assets you can enforce against?

    As CCM advised you should see a solicitor.
    Assuming you have the necessary proofs it is not rocket science to get a decree in the DC.
    The difficulty is in enforcing payment of the decree.

    The person has a car that is paid for. The value of it is €2000 max.

    The advice I was given was the if the case is won in my favor and I know where he currently lives and work. The judge can then order him to pay through his place of employment meaning that it would come straight out of his pay. 🀔

    At what rate though. Someone plays the poor mouth at court and a judge might order a deduction of €50 a month.

    In regards to leaving without notice there's a responsibility ro mitigate losses on your part.
