    Hi everyone,

A few year's ago I received personal injury compensation. I have been working for the past 9 month's and due to circumstances out of my control I have had to leave my job due to extreme stress.

Will I be entitled to any social welfare payments and/or will the social welfare be looking for money back off me from the illness benefit payments I was recieving after my accident a few year's back?

    Thanks for any insight folks

Speak to your social welfare officer, they will ask if you have received any compensation or are likely to receive some , they "should" know the system properly so you should speak with them and see if you are entitled to receive anything.

If you chose to leave your job (due to stress)...it was still your decision to leave it, you were not let go, unless you are planning some sort of constructive dismissal claim, given you were only working a few months I would suggest you goto your local office and apply, you may be entitled you may not ...but asking them will let you know, if you hid the previous compensation while claiming ... They might want it back, or they might decide it's not worth the paperwork.

Be honest with them, explain your situation and see if they can help.

if the business is owned by your father are you properly employed paying PRSI ? this may hinder you claiming benefits.

They will also ask for bank statements for means testing, if you have any substantial sum in an account they will (quite rightly) expect you to live off that first.

OP did not say he had been employed by his father

If he has paid PRSI and is claiming an insured benefit, means-testing won't come into it; the only question will be whether the relevant PRSI contributions have been paid and whether the qualifying conditions for the benefit are met. That's the whole point of social insurance.

If he's claiming a means-tested allowance, by contrast, then obviously there will be a means test.

OP: If you have to leave work due to stress, you may be entitled to disablity benefit. You should explore this possiblity.

Talk to your doctor and see if you could apply for illness benefit.

While I understand they can make a repayment claim on compensation awards, I'm not sure if they do in practice.

Note that you can have substantial savings before it affects your entitlements.

Ok so I have a few queries.

I work and my partner has a job but I think he’s going to be let go.

We were planning on having a family, we are not married - would he be entitled to claim social welfare if he is laid off and we have a child
My income is about 28k per annum
