Land registry fees

    Hello All,

    First time buyers here, offer accepted on a house built in 1999, and our solicitor has received the title documentation and contracts from the vendor's solicitor.

    Our solicitor has discovered that the house isn't registered with the property registration authority. They are saying it's a very straight forward process to register.

    They have now advised us that we have to pay land registry fees on top of the charges we were initially quoted. We understand that the charges quoted would possibly change, however, we are just unsure about the land registry fees.

    My question is, does anyone know if this is normal and up to the buyer to pay the fees to register the property? We are just wondering if the onus should be on the vendor or not? Of course, we are happy to pay what we should, it's just something we haven't considered, and we're not sure if we should question this with our solicitor or not.

    Any other advice about this process of registering with the PRA, and anything else we should consider?

    Yes, completely normal.
    The legislation changed a few years back whereby, previously you didn't have to fully register, now you have to. Its probably adding about €700 to your bill and most of that is the Land Registration fee.

    When the law changed, it doesn't effect existing owners, essentially every new sale needs to be registered, so in theory it will capture every property that is not registered as its sold into the future.

    OP you only pay outlay to property registration authority (PRA) once for registration. The fees depend on if it’s in the old system registry of deeds or new system land registry. Registry of deeds is cheaper. It’s €100 to registry the deed and mortgage in registry of deeds and is €130 to register the deed and mortgage in land registry. However legal fees are more expensive because you have to convert title from registry of deeds to new system. Law changed a few years ago and purchasers are required to convert the title.

    Land registry outlays are more expensive. And depends on value on the land but can be between €600-€1000. Also to register mortgage is €175.
    But for legal title review is easier so generally legal fees are lower.

    In the end I think it all balances out so regardless of what the title is, you end up nearly the same.
